  • Healthcare Provider Sues the IRS!

    The IRS has made it into the news once again!  This time it’s not because they are granting relief to victims of unfortunate circumstances, it’s actually because the IRS is being sued! Yes, sued. In fact, a health care provider has gone forth and sued the IRS along with a number of agents for allegedly wrongfully confiscating over 60 Million medical records from more than 10 million Americans! The name of the healthcare provider has not been released to the public just yet.

    According to the lawsuit, the IRS has violated the 4th Amendment. Back in 2011 the IRS had a search warrant to seize financial data for 1 employee; the IRS did not have permission to retrieve the medical information of those 10 million plus people!  According to UPI (United Press International) the IRS agents that performed this act were warned about the possibility of violating medical privacy laws prior to executing the warrant!

    UPI reported that the complaint states “Despite knowing that these medical records were not within the scope of the warrant, defendants threatened to ‘rip’ the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over.”

    The lawsuit also states that the IRS agents in question also had seized phone and telephone data, this is also a violation of the warrant.

    So what is this going to cost the IRS?  The lawsuit is seeking $25,000 in compensatory indemnity, per infringement.
